| 一、 | 依據銓敘部112年10月3日部退一字第1125617086號書函辦理。 |
| 二、 | 查國民年金法第7條第3款規定略以，未滿65歲國民，在國內設有戶籍而於該法施行後15年內，領取相關社會保險老年給付之年資合計未達15年或一次領取之勞工保險或其他社會保險老年給付總額未達新臺幣50萬元者，除應參加或已參加相關社會保險者外，應參加國民年金保險(以下簡稱國保)。先予敘明。 |
| 三、 | 次查上開規定於112年10月1日實施屆滿15年，凡自該日後領取相關社會保險老年給付(包含公教人員保險養老給付)者，均無法再參加國保。茲考量案涉公教人員保險被保險人個人日後參加國保權益，爰請協助宣導；至若被保險人尚有其他國保疑問，請其逕洽國保之主管機關或勞工保險局瞭解。 |
