轉知教育部有關退休教職員經審定支（兼）領月退休金再任政府機關編列預算支給薪酬職務，得否自願減少支領薪酬總額，以繼續支領（兼）月退休金疑義，請查照。
說明：
一、 依據教育部115年2月9日臺教人(四)字第1154200463號書函辦理，檢附原書函影本1份。
二、 查公立學校教職員退休資遣撫卹條例（以下簡稱退撫條例）第70條第3項、第77條及同條例施行細則第109條規定略以，退休教職員再任由政府編列預算支給俸（薪）給、待遇或公費（以下簡稱薪酬）之機關（構）、學校或團體之職務，且每月支領薪酬總額超過法定基本工資者（按：同時再任2個以上職務者，其個別職務每月所領薪酬收入應合併計算之），應停止領受月退休金，並停止辦理優惠存款，至原因消滅時恢復之。
三、 至教職員退休再任前開職務，得否自願減少支領薪酬總額至停止領受月退休金權利標準以下，以繼續支領月退休金一節，茲以依各職域法令規定進用人員，於各該法令已明定其薪資標準等相關規範，旨揭疑義因涉及各該規範適用問題，仍應先就退休人員再任職務之支薪規定確認得否依當事人意願減少薪酬，再依退撫條例相關規定辦理。
四、 該部91年12月16日台（91）人（三）字第91184221號書函停止適用。
