| 一、 | 依銓敘部115年8月26日部法二字第1156000459號書函辦理，並檢附原書函影本1份。 |
| 二、 | 中央選舉委員會及各地方選舉委員會業於115年8月20日發布旨揭地方公職人員選舉之公告，並將於同年8月31日至9月4日受理候選人登記之申請，請各機關人員於選舉期間，確依公務人員行政中立法（下稱中立法）相關規定嚴守行政中立。 |
| 三、 | 依公務員服務法第6條及第20條規定，公務員應謹慎勤勉，且非因職務之需要，不得動用行政資源。次依中立法相關規定，公務人員不得為支持或反對特定政黨或公職候選人，利用職權或動用行政資源從事相關政治活動或行為；亦不得要求他人對於公職人員之選舉不行使投票權或為一定之行使。基上，為確保依法行政、執行公正及政治中立，公務人員於公職人員選舉辦理期間，除不得違反中立法相關規定外，亦不得「動用行政資源」、「利用職務關係」、「影響公務執行」或「使用職銜名器」支持或反對特定政黨、公職候選人。又有關公民投票案相關事項，依中立法第10條及其施行細則第7條規定，公務人員不得利用職務上之權力、機會或方法，要求他人不行使投票權或為一定之行使，至基於職責受指示辦理宣傳機關政策相關事宜，或受指派代表機關表達行政機關立場之行為，則無違中立法之規定。 |
| 四、 | 又依中立法第14條第1項規定，長官（含政務人員及民選首長）不得要求公務人員從事中立法禁止之行為。此外，依同法第13條規定，各機關首長或主管人員於選舉委員會發布地方公職人員選舉公告起至投票日止，應禁止政黨、公職候選人或其支持者基於宣傳、造勢或拜票等意圖所為造訪活動，並應於機關學校固定辦公或處理公務之場所各出入口明顯處所，張貼禁止競選活動之告示，以維政府機關行政中立之公正形象。 |
